These Terms & Conditions (“Terms”) govern your access to and use of our website https://smokesafer.in/ (the “Site”), and the purchase or use of products and services offered on or through the Site. By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please refrain from using the Site.

1. About Us

The Site is owned and operated by Tarush Golf Systems (“we”, “us”, “our”), with principal place of business in Noida, Uttar Pradesh, India.

2. Eligibility & Age Restriction

By using the Site, you represent that you are at least 18 years of age and competent to contract under the Indian Contract Act, 1872. You must not allow any minor to use the Site or purchase products intended for adults.

3. Changes to the Terms

We may modify these Terms from time to time. Material changes will be notified by posting an update on this page and/or by other reasonable means. Your continued use of the Site after the effective date of any changes constitutes your acceptance of the revised Terms.

4. Products & Information

• We offer accessories that aim to reduce certain undesirable components from cigarette smoke through filtration. Our products are not medical devices, are not smoking cessation aids, and do not eliminate the health risks of smoking.
• Product descriptions, images, availability, and pricing are provided in good faith; however, errors may occur and we reserve the right to correct them and to discontinue or modify products at any time.
• Any third‑party studies, demonstrations, or data referenced on the Site are for informational purposes only and may not reflect individual results.

5. Health & Safety Disclaimer

• Smoking tobacco carries serious health risks. Use of our filters cannot make smoking safe and does not prevent disease. If you wish to quit smoking, consult a healthcare professional.
• Do not use our products if you are allergic or sensitive to any material used in the filter components. Discontinue use if irritation occurs.
• Keep all products out of reach of children and pets.

6. Legal Compliance (India)

You agree to comply with all applicable Indian laws and regulations, including, where applicable, the Cigarettes and Other Tobacco Products Act, 2003 (COTPA) and related rules, as well as any state‑level restrictions regarding sale, advertising, display, and use of tobacco‑related accessories. You acknowledge that:

• We do not sell tobacco, nicotine, or e‑cigarette devices. Our products are accessories meant for adult smokers.
• We may display statutory health warnings and age‑gating on the Site and may require age verification before purchase or delivery.
• We reserve the right to refuse or cancel orders to locations where sale or advertisement of such accessories is restricted or prohibited.

7. Orders, Pricing, Payment & Taxes

• All prices are in Indian Rupees (INR) unless stated otherwise. Taxes (including GST) and delivery charges are shown at checkout where applicable.
• Placing an order is an offer to buy; acceptance occurs when we dispatch the product and confirm shipment.
• We may refuse or cancel any order due to product availability, suspected fraud, errors in pricing/description, or legal/compliance reasons.
• Payments are processed by authorised third‑party payment gateways. We are not responsible for their acts or omissions. You must provide accurate billing and delivery details.

8. Shipping, Delivery, Returns & Refunds

Shipping timelines, delivery coverage, return eligibility, and refund procedures are governed by our separate Shipping & Returns Policy, which is incorporated by reference. Please review it before placing your order.

9. Acceptable Use

• Do not use the Site for unlawful purposes or to violate any applicable laws or regulations.
• Do not interfere with or disrupt the Site, servers, or networks, or attempt to gain unauthorised access to the Site or user accounts.

• Do not upload, post, or transmit any content that is harmful, defamatory, obscene, infringing, or otherwise objectionable.

15. Suspension & Termination

We may suspend or terminate access to the Site or your orders at our discretion for suspected fraud, abuse, security issues, non‑payment, or violation of these Terms or applicable law. Upon termination, provisions that by their nature should survive will remain in effect.

16. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Subject to applicable dispute resolution provisions below, the courts at Noida, Uttar Pradesh, India shall have exclusive jurisdiction.

17. Dispute Resolution

Before initiating litigation, the parties shall attempt to resolve disputes amicably through good‑faith negotiations for at least 30 days after written notice. If unresolved, parties may refer the dispute to arbitration in accordance with the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually. The seat and venue of arbitration shall be Noida, Uttar Pradesh. The arbitration shall be conducted in English. Each party shall bear its own costs, and the arbitrator may apportion costs in the award.

18. Miscellaneous

• Severability: If any provision is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
• No Waiver: Our failure to enforce any right or provision is not a waiver of such right or provision.
• Assignment: You may not assign your rights or obligations without our prior written consent. We may assign our rights and obligations without restriction.
• Entire Agreement: These Terms, together with policies referenced herein, constitute the entire agreement between you and us regarding the Site and products.
• Force Majeure: We are not liable for delays or failures due to causes beyond our reasonable control.
